A seller of property in Victoria is required to disclose issues such as structural problems, damp, insect infestation or fixtures and appliances that do not work. You are breaking the law if you knowingly conceal from a potential buyer a material fact about a property you are selling.

Section 27 of the Sale of Land Act provides for release of the deposit to a Vendor prior to the settlement date. In order to obtain release of the deposit prior to settlement, a Vendor is required to produce a letter the mortgagee which will provide details of the mortgage and enable the preparation of the Section 27 Statement for service upon the Purchaser. The Purchaser has 28 days from receiving the Section 27 Statement to lodge an objection of release of deposit and, should no objection be lodged, deposit monies will be released on expiry of the 28 day period.
On the day of settlement you will need to vacate the property by settlement time, cancel all direct debits for utilities and rates and arrange for final readings.
